State Supreme Court to review court decision to give WSU, OSU control of Pac-12 board

OLYMPIA, Wash. — The Washington Supreme Court will be reviewing the decision that ruled in favor of Washington State and Oregon State to be sole members of the Pac-12 governing board.

The Supreme Court on Dec. 15 will look at this case during their en banc meeting. This meeting is where justices gather to consider and deliberate on cases and case questions.

This meeting will not be open to the public or recorded while they discuss these matters.

On Dec. 14, Whitman County Superior Court Judge Gary Libey ruled that WSU and OSU should be the only governing members of the Pac-12 board of directors.

But during the hearing, attorneys for University of Washington said that they had plans to challenge this ruling and asked Judge Libey to stay his decision to give them time to do so.

Libey agreed to stay on his ruling and the court asked both parties to file briefs regarding UW’s emergency stay request by Nov. 28.

Then on Nov. 28, UW filed an emergency motion to stay in the Pac-12 case that was ruled in favor by the Supreme Court.

With this filed, the emergency motion lets UW “stay the injunction pending direct discretionary review of the superior court’s order.”

Now on Dec. 15 the Supreme Court will discuss the decisions made by Whitman County Superior Court Judge Gary Libey. They don’t have a specific timeline for deliberation and cannot guarantee that there will be a decision made tomorrow.

This review will not be open to the public and will not be recorded.
