Majorjon Kaylor, Kellogg murder suspect, files motion to dismiss 2 murder charges

WALLACE, Idaho — The man accused of murdering four people in Kellogg on Jun. 18, has filed a motion to dismiss two of the four first-degree murder charges.

Majorjon Kaylor filed a motion Wednesday to dismiss the murder charges for 65-year-old Kenneth Guardipee and his daughter 41-year-old Kenna Guardipee.

In the motion, Kaylor told detectives that he had been in a “heated argument” with Kenna and Kenneth and was upset that they were not “taking his concerns about Devin seriously.”

Kaylor’s attorney’s state that the prosecution has not provided evidence that suggests their murders were premeditated. They continue by expressing that there is nothing to suggest that Kaylor had a “prior grudge” against the Guardipee’s.

“There were no proof of threats towards the Guardipee’s or mistreatment towards them… [Kaylor] spoke with neighbors and police directly after the incident regarding his role,” said Kaylor’s attorney. “Rather law enforcement’s account tends to show that the offenses were committed following a heated argument during which Mr. Kaylor became upset, not that he approached the Guardipee’s already upset and planned to kill them as some sort of payback.”

The defense is requesting a 45-minute hearing to present evidence and arguments in support of dismissing these two charges. Kaylor’s attorney believes the state cannot prove that the murders of the Guardipees were planned.

Majorjon Kaylor pleaded not guilty to all counts of first-degree murder at his arraignment on Sept. 13. His trial is set to begin on Jan. 9, 2024.
