DEER PARK, Wash – The 8-year-old boy who was shot in Deer Park last week was shot by his brother, new court documents show.

Police filed a search warrant for the 10-year-old Deer Park Boy on October 3rd. The boy is being investigated for murder and manslaughter, according to court documents.

Court documents say that Atillio “Tilly” Stanley and his two older siblings, aged 10 and 13, were playing under the supervision of their Grandmother, Barbara Spencer. Spencer called 911, telling the operator her grandchild had been shot. However, she was unable to check the scene because she was disabled. The oldest of the grandchildren, age 13, told the operator that one of his younger brothers had been shot in the head.

Spokane County sheriff’s arrived quickly and pronounced the 8-year-old dead on the scene. The children’s father, Jason Stanley, and his girlfriend came shortly after. Deputies were told by Tilly’s oldest sibling that before the shooting, the brothers were not fighting and described the incident as follows.

Tilly pulled the pistol out of the cabinet or dresser drawer in the room where they were playing. He then took the gun away from the youngest sibling. The 10-year-old then picked up the gun and “cocked it” when he cocked the weapon it fired, and the bullet struck Tilly in the head.

Deputies asked the children’s father about the gun, and he said he was holding it for a friend. This case remains under investigation.
