Post Falls man with a “lengthy criminal history” sentenced for attempted strangulation

POST FALLS, Idaho – A Post Falls man with a “lengthy criminal history” was sentenced after attempting to strangle his partner in 2023.

Elton Joe Roberts, 46, has nearly two dozen convictions over 30 years, including, “petit theft, resisting officers, possession of controlled substances, battery, domestic battery, lewd conduct with a minor under sixteen, failing to register as a sex offender, disturbing the peace, bail jumping, and many, many probation violations,” according to Prosecuting attorney Stanley Mortensen.

Mortensen said in Oct. 2023, Roberts attempted to choke and strangle his partner.

District Judge John Mitchell sentenced Roberts to 15 years and retained jurisdiction over him.

“A retained jurisdiction (more commonly known as a ‘rider’) allows a defendant to spend up to one year in a prison based treatment program before returning to court where the judge will decide to either place the defendant on probation or leave them in prison for the remainder of their sentence,” said Mortensen.
