North Idaho College president wins lawsuit to get public records withheld by board

COEUR D’ALENE, Idaho — North Idaho College President Nick Swayne won his second lawsuit against the board of trustees for school he leads on Wednesday.

Swayne sued the board in November to get access to an investigation into allegations against him.

On Wednesday, Kootenai County District Court Judge Barry McHugh granted that request, ordering North Idaho College to turn over the report to Swayne. McHugh did allow redactions of any allegations in the report that involve parties other than Swayne.

The board authorized the investigation into unspecified allegations against Swayne at a board of trustees meeting on June 7, 2023.

Swayne’s lawsuit said the school had denied his formal public records request to get access to the document. The lawsuit was prompted in part by an Oct. 23 performance review in which Swayne said then-board chair Greg McKenzie referenced the content of the investigation “numerous times.”

The legal victory marks a second straight win for Swayne. The North Idaho College president previously sued the board when it placed him on leave. A judge sided with him in that case, determining the board didn’t act in good faith.
