Freeman school shooter ordered to be resentenced by Washington Court of Appeals

SPOKANE, Wash. – The Freeman High School shooter, Caleb Sharpe was originally sentenced to 40 years in prison after pleading guilty in 2022. Now just two years later, the court will require a resentencing due to a Washington Court of Appeals recent decision.

Sharpe was 15 years old when he opened fired in a Freeman Highschool hallway killing one and injuring three others.

On Tuesday, the Washington Court of Appeals decided to review Sharpe’s 40-year sentence, considering several challenged factors.

According to Washington State Law, a defendant who was under 16 years old at the time of the crime is subject to a maximum prison sentence of 25 years to life.That means that Sharpe’s original sentence of 40 years is being contested as unconstitutional based off state law. The State agreed with the argument and required a resentencing.Sharpe also argued that the gun enhancement charges should not have been considered in his sentencing because he was under 16 years old. The state disagreed with this appeal and the court left the decision to be argued by the parties at the resentencing. Sharpe also contended his statements to police at the time of the shooting should not have been considered during his original sentencing.The state agreed on that appeal.
