Attorneys for Bryan Kohberger file alibi response ahead of deadline

MOSCOW, Idaho — The man accused of killing four University of Idaho students in 2022 submitted a response to prosecutor’s demand for an alibi ahead of a deadline Wednesday evening, slightly clarifying an alibi given previously.

“Mr. Kohberger was out driving in the early morning hours… as he often did to hike and run and/or see the moon and stars,” the filing reads. “He drove throughout the area south of Pullman, Washington, west of Moscow, Idaho including Wawawai Park.”

The alibi closely resembles an August 2023 defense filing, that offered that Kohberger “has long had a habit of going for drives alone” at night, and that he was doing exactly that on the night of Nov. 12, 2022 — the night Maddie Mogen, Xana Kernodle, Ethan Chapin and Kaylee Goncalves.

On Wednesday, Kohberger’s attorneys also said they intend to offer testimony from an expert who they believe has cell tower evidence that proves Kohberger’s mobile device didn’t’ travel east on the Moscow-Pullman Highway on Nov. 13, 2022, “and thus could not be the vehicle captured on video” cited in the affidavit of facts in the case.

Kohberger’s attorneys also said the expert’s testimony would reveal that exculpatory wasn’t preserved or was withheld.

Wednesday’s filing wasn’t discussed in a public hearing. Kohberger’s next scheduled hearing is a highly anticipated change of venue hearing on May 14 for.
