OLYMPIA, Wash. – The Washington State Supreme Court issued an emergency stay on a lower court’s ruling of the state’s high-capacity magazine ban as unconstitutional on Monday.
The Monday Cowlitz County Superior Court judge decision ruled that a 2022 state law banning large capacity magazines is unconstitutional, though additional details offered by the court were sparse due to a county policy requiring all court records to be purchased.
“The Court had intended to make copies of the ruling available to the public via this website, however, all official copies of court rulings must be distributed through the Superior Court Clerk,” the Cowlitz County said.
The ruling in the case which pits Washington Attorney General Bob Ferguson against Gatos’s Custom Guns was swiftly denounced by Ferguson.
“Today’s decision is incorrect and we will immediately file a motion asking the State Supreme Court to keep this public safety law in effect,” Ferguson said.
The Attorney General’s request came to fruition just hours later when the Washington Supreme Court issued an emergency stay of the Superior Court ruling.
Until the state’s highest court rules on the case, the high-capacity magazine ban will remain in place.
