ICE agent’s social media posts questioned in Spokane protest trial

SPOKANE — An ICE agent’s social media posts became the focus of a federal trial today involving three people charged in a Spokane ICE protest.

ICE Agent Jeremy Burlingame said he forgot about his X account. Defense lawyers showed the jury more than a dozen posts with disparaging comments about African Americans and LGBTQ people. Burlingame deleted the account last night.

The posts called a congresswoman “ghetto garbage” and referred to transgender people as “mentally ill.” All posts were made from early 2025 onward.

Prosecutors say they were never told about Burlingame’s social media account.

Defense lawyers worry about Burlingame’s bias against defendant Jac Archer, who is African American and non-binary. The other two defendants, Bajun Malvalwalla and Justice Forral, use they/them pronouns.

All three face conspiracy charges for their roles in a June 11, 2025 protest at the Spokane ICE office.

Prosecutors have contacted ICE about disciplinary action against Burlingame. ICE has started that process.

The defense also showed body camera footage from Spokane County Sheriff’s Deputy Brittan Morgan. In the video, Morgan says, “I want to hit someone with a stick.”

Morgan testified he regrets saying that and didn’t know his body camera was on.

An FBI agent also testified about screenshots showing Jac Archer encouraging people to “thoughtfully risk arrest” at the protest through Signal group chats.

The trial could last until next Friday. It’s unclear if the defense will ask for a mistrial.
