Federal agents testify in Spokane ICE protest trial

SPOKANE, Wash. — Two federal agents testified Thursday about physical altercations with protesters during last summer’s demonstration at the Spokane Immigration and Customs Enforcement facility.

The Homeland Security officers described confrontations from the June 11 protest. Three people — Bajun Malvalwalla, Jac Archer and Justice Forral — face federal charges of impeding or injuring officers.

Prosecutors showed video of protesters linking arms and forming a wall in front of the facility’s gate to prevent federal agents from transporting ICE detainees. The prosecution argues the three defendants are part of the group that impeded federal agents, even if they weren’t directly involved in physical altercations.

The federal agents testified they contacted Spokane Police early in the protest, but SPD didn’t respond until much later that evening.

Defense attorneys questioned the agents about calls to the U.S. Attorney’s Office requesting help. The defense claims both offices told federal agents to wait out protesters and de-escalate, but prosecutors objected to including this testimony.

Two Spokane Police officers also testified about escorting a Border Patrol van during the protest. SPD Officer Tyler Heiman’s body camera footage showed Justice Forral interacting with police officers. According to Heiman’s testimony, he believes Forral said, “I’ll keep it peaceful until it’s not.”

The trial is expected to continue through next Friday.
